Welcome to Borderless Inc ("Borderless," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our citizenship and residency coordination services. By engaging our services or using our website, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of these Terms, you may not use our services.
1. Services Overview
What We Do
Borderless provides citizenship and residency coordination services for U.S. citizens seeking second citizenship or residency abroad through:
- Heritage Pathways: Citizenship by descent (ancestry-based citizenship)
- Residency Pathways: Long-term residency leading to citizenship
- Investment Pathways: Citizenship or residency through qualified investments
Our services include:
- Eligibility assessment and consultation
- Document gathering, preparation, and translation coordination
- Apostille and authentication services coordination
- Consulate representation via Power of Attorney
- Application submission and status tracking
- Ongoing communication with government agencies
What We Are NOT

- We CANNOT guarantee approval of any application
We are a coordination service that manages the administrative and logistical aspects of citizenship and residency applications. For legal questions or complex immigration matters, we work with licensed immigration attorneys.
2. Eligibility and Client Responsibilities
Client Eligibility
To use our services, you must:
- Be a U.S. citizen (our services are exclusively for American citizens)
- Be at least 18 years of age (or have parental/guardian consent)
- Provide accurate and complete information
- Have a legitimate basis for citizenship or residency in the target country
Your Responsibilities
As a client, you agree to:
- Provide truthful, accurate, and complete information
- Respond promptly to requests for documents or information
- Inform us immediately of any changes to your personal circumstances
- Cooperate fully throughout the application process
- Maintain the confidentiality of any login credentials or account information
- Pay all fees according to the agreed payment schedule
- Comply with all laws and regulations of both the U.S. and the target country
3. Service Fees and Payment Terms
Service Tiers
We offer multiple service levels with different fee structures. Specific pricing will be provided during your consultation and outlined in your Service Agreement.
Payment Structure
Our standard payment structure is:
- Initial Deposit: 50% upon signing the Service Agreement
- Midpoint Payment: 25% upon application submission
- Final Payment: 25% upon approval/completion
Alternative payment arrangements may be negotiated and documented in your Service Agreement.
Government Fees
Important: Our service fees do NOT include government application fees, translation costs, apostille fees, document retrieval costs, or other third-party expenses. These additional costs are your responsibility and will be clearly communicated before being incurred.
Refund Policy
Due to the immediate work required upon engagement:
- Initial Deposit: Non-refundable once work has commenced (typically within 48 hours of payment)
- Subsequent Payments: Refundable only if we fail to deliver the services outlined in your Service Agreement
- Government Fee Rejections: If your application is rejected by the government, our service fees are non-refundable, as we cannot control government decisions
4. No Guarantees or Warranties

- Approval of your citizenship or residency application
- Specific processing timeframes (government timelines vary and are outside our control)
- That you will qualify for citizenship or residency
- Any particular outcome or result
Government agencies have sole discretion over application approvals. Processing times, requirements, and policies can change without notice. We will make our best efforts to provide accurate eligibility assessments and prepare thorough applications, but final decisions rest with government authorities.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Our Liability is Limited
Borderless Inc, its owners, employees, and contractors shall not be liable for:
- Application rejections by government agencies
- Delays caused by government processing, consulates, or third parties
- Changes in immigration laws, policies, or requirements
- Loss of opportunity, income, or other consequential damages
- Errors or delays caused by third-party service providers (translators, couriers, etc.)
- Acts of God, natural disasters, political instability, or other events beyond our control
Maximum Liability
Our total liability to you for any claims arising from our services shall not exceed the total fees you have paid to us for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Borderless Inc from any claims, damages, or expenses arising from:
- Your provision of false or misleading information
- Your violation of any laws or regulations
- Your breach of these Terms
6. Power of Attorney and Representation
Authorization
By engaging our services, you may grant us Power of Attorney (POA) to act on your behalf in matters related to your citizenship or residency application. This authorization allows us to:
- Submit applications and documents to government agencies
- Communicate with consulates and immigration authorities
- Retrieve documents on your behalf
- Sign certain documents as your authorized representative
Scope of Authority
Our POA is limited in scope to citizenship and residency application matters only. We do not have authority to:
- Make financial decisions on your behalf
- Enter into contracts unrelated to your application
- Make legal decisions requiring attorney representation
Revocation
You may revoke the Power of Attorney at any time by providing written notice. However, revocation does not entitle you to a refund of fees for work already completed.
7. Confidentiality and Data Privacy
We take your privacy seriously. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key points:
- We will keep your information confidential and secure
- We will only share your information as necessary to provide our services
- We maintain data for 7 years after service completion for legal and tax purposes
- You may request access to or deletion of your data (subject to legal retention requirements)
8. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Borderless Inc or its licensors and is protected by copyright and trademark laws.
You may not:
- Copy, reproduce, or distribute our content without permission
- Use our name, logo, or branding without authorization
- Reverse engineer or attempt to access our proprietary systems
9. Termination
Your Right to Terminate
You may terminate our services at any time by providing written notice. Upon termination:
- You remain responsible for payment of fees for work completed
- We will return any original documents in our possession
- We are not obligated to provide refunds for fees already paid (except as outlined in Section 3)
Our Right to Terminate
We reserve the right to terminate our services if:
- You fail to make required payments
- You provide false or misleading information
- You fail to cooperate or respond to reasonable requests
- Your conduct is abusive, threatening, or inappropriate toward our staff
- We determine we cannot ethically or legally assist with your case
10. Dispute Resolution
Governing Law
These Terms shall be governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Informal Resolution
Before initiating any formal legal proceedings, you agree to contact us to attempt to resolve the dispute informally. We commit to working in good faith to address your concerns.
Arbitration
If informal resolution is unsuccessful, any disputes arising from these Terms or our services shall be resolved through binding arbitration in Naples, Florida, in accordance with the rules of the American Arbitration Association.
You agree to waive your right to a jury trial and to participate in class action lawsuits.
Exceptions
Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.
11. Changes to Terms of Service
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Effective Date."
For active clients, we will notify you of material changes via email. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and your Service Agreement, constitute the entire agreement between you and Borderless Inc regarding our services and supersede all prior agreements or understandings.
14. Force Majeure
We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to:
- Natural disasters, pandemics, or public health emergencies
- War, terrorism, or civil unrest
- Government actions, strikes, or labor disputes
- Failure of third-party services or utilities
- Changes in immigration laws or consulate closures
15. Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
16. Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets.
17. Third-Party Services
We may engage third-party service providers (translators, genealogists, attorneys, etc.) to assist with your application. While we carefully vet these providers, we are not responsible for their errors, omissions, or misconduct.
18. Electronic Communications
By engaging our services, you consent to receive communications from us electronically, including via email. You agree that electronic communications satisfy any legal requirement that communications be in writing.
19. Client Testimonials and Reviews
You grant us permission to use your testimonials, reviews, or feedback (with or without your name) for marketing purposes, unless you explicitly opt out in writing.
